Premises Liability (Slip and Fall)
A premises case occurs when you are injured on someone else property due to their negligence. Some examples of common premises case
are when something slippery is left on the floor and causes a person to fall or when heavy merchandise falls from a shelf and hurts
someone.
To be successful you must prove both liability and negligence (which are discussed on the personal injury page). To establish
negligence you must prove that the store knew or should have known that there was a dangerous condition. You must also be able to
show that it was not a condition that was open an obvious for all to see.
